Terms of Sale

1. About these terms

These Terms of Sale (“Terms”) set out the terms and conditions on which we supply products to you. Please read these Terms carefully before placing an order. By placing an order with us, you confirm that you accept these Terms and agree to be bound by them.

These Terms apply to consumer purchases. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and other applicable consumer protection legislation.

3. The contract between us

The steps required to create a contract between you and us are as follows:

  • You place an order for products by following the on-screen instructions. Each order is an offer by you to purchase the products subject to these Terms.
  • We will send you an order acknowledgement confirming that we have received your order. This acknowledgement does not constitute acceptance of your order.
  • A binding contract is formed only when we send you an order confirmation or dispatch confirmation. At that point a contract will come into existence between you and us.

If we are unable to accept your order, we will inform you and will not charge you for the products. This may be because the product is out of stock, because of an error in the price or description, or because we are unable to meet a delivery deadline.

4. Products

The images and descriptions of products on our website are for illustrative purposes only. While we make every effort to display product details accurately, the actual product may vary slightly, including in colour, depending on your device’s display settings.

All products are subject to availability. We may withdraw or discontinue any product at any time.

5. Price and payment

The price of the products will be the price set out on our website at the time you place your order, except in the case of an obvious pricing error. Prices include VAT where applicable but exclude delivery charges, which are shown separately before you confirm your order.

If we discover an error in the price of products you have ordered, we will contact you to ask whether you wish to continue with the order at the correct price or cancel it. If the pricing error is obvious and could reasonably have been recognised by you as an error, we are not obliged to supply the products at the incorrect price.

Payment for all products must be made in full at the time of placing your order. Payment is processed securely by our third-party payment providers. We do not store full payment card details.

6. Delivery

We will deliver the products to the delivery address you provide when placing your order. Estimated delivery timescales and charges are shown during the checkout process.

Delivery times are estimates only and are not guaranteed. We are not responsible for delays outside our reasonable control, but if delivery is delayed we will contact you and take reasonable steps to minimise the delay.

Delivery is completed when the products are delivered to the address you provided. Responsibility for the products and the risk of loss or damage passes to you upon delivery. Ownership of the products passes to you once we have received payment in full and the products have been delivered.

If no one is available to take delivery, the carrier may leave a note explaining how to rearrange delivery or collect the products. If you do not collect the products or rearrange delivery, we may charge you for storage and further delivery costs, or end the contract.

7. Your right to cancel and return

Because you are a consumer purchasing online, you have a legal right to cancel your order under the Consumer Contracts Regulations 2013, in addition to your other statutory rights. Full details of how to cancel and return products, and the circumstances in which the cancellation right does not apply, are set out in our separate Refund Policy, which forms part of these Terms.

8. Faulty or misdescribed products

We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. If a product you receive is faulty, damaged or not as described, you are entitled to a remedy under the Consumer Rights Act 2015. Please see our Refund Policy for further information on how to claim a remedy.

Nothing in these Terms limits or excludes your statutory rights.

9. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if it was contemplated by you and us at the time the contract was formed.

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the products.

We supply our products for domestic and private use. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity arising from use of the products for any commercial purpose.

10. Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an event outside our reasonable control, including but not limited to strikes, failure of telecommunications networks, supplier or carrier failure, fire, flood, severe weather and acts of government.

11. Ending the contract

You may end the contract in accordance with your cancellation rights set out in our Refund Policy. We may end the contract if you do not make any payment when due, or if you do not, within a reasonable time, allow us to deliver the products to you.

12. Complaints

We aim to provide a high standard of service. If you are not satisfied with any aspect of your order or our service, please contact us using the details in section 2 and we will do our best to resolve the matter promptly.

13. General
  • Assignment: we may transfer our rights and obligations under these Terms to another organisation. Your rights under these Terms will not be affected.
  • Severability: if any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.
  • Variation: we may revise these Terms from time to time. The Terms that apply to your order are those in force at the time you place it.
  • Third parties: this contract is between you and us. No other person has any rights to enforce any of these Terms.
14. Governing law and jurisdiction

These Terms and any contract formed under them are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction, although if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
